Luxury Next Season / Terms of Service
Terms for the Luxury Next Season website, products and services.
These Terms govern use of the Luxury Next Season website and, where applicable, physical-product transactions and Fashion Access services. Project-specific written terms may supplement these Terms.
Effective date: September 12, 2026.
1. Agreement to these Terms
By accessing the Luxury Next Season website, submitting an enquiry, purchasing a product where commerce is available, or accepting a written Luxury Next Season service engagement, you agree to the terms applicable to that activity. If a signed or otherwise accepted project-specific agreement conflicts with these general Terms, the project-specific agreement controls for that engagement to the extent of the conflict.
2. About Luxury Next Season and current commerce status
Luxury Next Season is a New York-based fashion platform. General online product sales are currently paused. The website may nevertheless support existing orders, private sourcing, selected future product transactions and paid professional services. The presence of editorial product or brand content does not mean that an item is currently offered for sale or that Luxury Next Season represents the brand.
3. Website information
Luxury Next Season aims to keep website information accurate and current, but fashion availability, pricing, schedules, third-party information and editorial content can change. Historical articles and press archives may describe earlier phases of Luxury Next Season and are preserved as historical material rather than current commercial offers.
4. Enquiries and service engagements
Submitting a form, sending an email, having a preliminary conversation or receiving an introduction does not by itself create a paid service engagement. A service engagement begins when Luxury Next Season and the client accept in writing the applicable scope, fees, timing and material responsibilities. An accepted proposal, statement of work, invoice, email confirmation or other written record may form part of the engagement.
5. Fees and payments
Service fees, retainers, deposits, advance payments, milestones and invoice timing are stated in the applicable written engagement. Taxes and approved third-party costs are additional unless expressly included. Luxury Next Season may require payment before reserving capacity, committing third-party costs, purchasing an item or beginning specified work. Luxury Next Season may pause work on materially overdue amounts where permitted by the engagement terms and applicable law.
6. Private sourcing and product purchases
Luxury Next Season may locate or facilitate access to items through brands, authorized retailers, boutiques, showrooms, resellers, collectors or other independent sources. Before commitment, Luxury Next Season will identify the known purchasing route and material conditions where reasonably practicable. Depending on the transaction, Luxury Next Season may sell an item directly or facilitate a purchase from a third party. Availability and price can change until the purchase is confirmed and paid.
7. Third-party product terms
When an item is supplied by a third party, that provider may control processing times, shipping, returns, exchanges, credits, authenticity documentation, warranties and other product conditions. Luxury Next Season may assist with communication or a permitted return, but cannot create a refund or exchange right that the third-party provider does not offer, except where applicable law requires otherwise.
8. Shipping, duties and taxes
Physical orders are subject to the Service Order & Delivery page and any transaction-specific terms. Unless expressly included, customs duties, taxes, brokerage charges and other destination charges are the recipient's responsibility. Delivery estimates are not guarantees unless Luxury Next Season expressly agrees otherwise in writing.
9. Product returns and service cancellations
Physical merchandise returns are governed by the Physical Orders section of Service Order & Delivery; cancellation requests follow the Cancellation Policy together with the terms disclosed for the specific transaction. Services are not treated as merchandise returns. Work already performed, expressly reserved capacity and authorized non-cancellable third-party commitments may remain payable to the extent stated in the written engagement and permitted by law.
10. Market entry, introductions and third-party outcomes
Luxury Next Season may provide market reading, positioning, access, outreach or introductions. Luxury Next Season does not guarantee that a buyer, retailer, media outlet, producer, investor, brand, creative or other third party will accept an introduction, respond, meet, place an order, offer coverage, enter a partnership or produce any other commercial result. Fees are paid for the agreed work, judgment, time and deliverables, not for a guaranteed independent decision by another party.
11. Screen & Talent Styling and creative work
Fashion-direction and wardrobe work may depend on sample availability, sizing, brand approvals, production schedules, garment condition and other third-party factors. Clients must provide timely approvals and comply with any loan, care, alteration and return conditions communicated for samples, garments and accessories.
12. Client responsibilities
Clients must provide accurate information, timely decisions and materials they are entitled to use. A client is responsible for obtaining permissions for materials, trademarks, images, music, likenesses, data or other content supplied to Luxury Next Season for a project. Client delays or changes may affect timing, feasibility and fees.
13. Confidentiality and discretion
Luxury Next Season treats private sourcing requests, sensitive commercial discussions and non-public project information with discretion. Formal confidentiality obligations, if required, should be set out in the applicable engagement or NDA. Nothing in these Terms requires disclosure of another client's confidential information or of a third party's confidential contact information.
14. Intellectual property
The website, Luxury Next Season name and marks, original editorial material, brand assets and Luxury Next Season's pre-existing methods, templates, systems and know-how remain owned by Luxury Next Season or the applicable rights holder. Ownership and permitted use of custom project deliverables are governed by the project-specific agreement. No website content may be copied, scraped, republished or commercially exploited except as permitted by law or with written permission.
15. Third-party names, links and services
References or links to brands, retailers, publications, nonprofits, platforms or other third parties do not by themselves state an endorsement, agency, partnership or representation relationship. Third-party sites and services operate under their own terms, policies and practices.
16. Acceptable use
You may not misuse the site, interfere with its operation, attempt unauthorized access, transmit malicious code, collect information unlawfully, impersonate another person, infringe intellectual-property or privacy rights, or use Luxury Next Season materials to create a false impression of affiliation or endorsement.
17. Disclaimer of website warranties
To the fullest extent permitted by law, the website and general informational content are provided on an "as available" basis. Luxury Next Season does not promise uninterrupted access or that every error will be corrected immediately. Paid services will be performed in accordance with the applicable written engagement; no disclaimer in these Terms limits obligations that cannot lawfully be excluded.
18. Limitation of liability
To the fullest extent permitted by applicable law, Luxury Next Season will not be liable for indirect, incidental, special, exemplary, punitive or consequential losses, including lost profits or lost opportunities, arising from the website or an engagement. To the extent a monetary limitation is legally permitted, Luxury Next Season's aggregate liability arising from a specific product transaction or service engagement will not exceed the amounts paid to Luxury Next Season for that specific transaction or engagement. These limitations do not apply where applicable law prohibits them.
19. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold Luxury Next Season and its personnel harmless from third-party claims, losses and reasonable costs arising from your unlawful use of the website, your breach of these Terms, materials or instructions you supply without the necessary rights, or your violation of another person's rights. This provision does not require indemnification for Luxury Next Season's own conduct where prohibited by law.
20. Events outside reasonable control
Luxury Next Season is not responsible for delay or failure caused by events outside its reasonable control, including carrier or customs disruption, supplier failure, venue closure, severe weather, labor disruption, government action, platform outage or similar events. Luxury Next Season will use reasonable efforts to communicate material effects on an active engagement.
21. Suspension and termination
Luxury Next Season may suspend website access or service work for material misuse, unlawful conduct, material non-payment or a material breach of an engagement, subject to applicable law and the project terms. Termination does not erase payment obligations, confidentiality duties, intellectual-property provisions or other terms that by their nature should survive.
22. Informal resolution, mediation and arbitration
Before starting formal proceedings, the parties will first attempt in good faith to resolve a dispute by written notice describing the issue and requested resolution. If the dispute cannot be resolved informally, the parties agree, to the extent enforceable, first to attempt mediation administered by the American Arbitration Association under applicable procedures before proceeding to binding arbitration.
Except for a claim eligible for small-claims court or a request for appropriate injunctive relief concerning intellectual-property or misuse of confidential information, any unresolved dispute arising from these Terms, the website, a product transaction or a Luxury Next Season service will, to the extent enforceable, be resolved by binding individual arbitration administered by the American Arbitration Association under the rules applicable to the dispute. The Federal Arbitration Act governs the arbitration provision. Arbitration will proceed on an individual basis only; class, collective and representative proceedings are waived to the extent that waiver is enforceable. Nothing here waives a right that applicable law does not permit the parties to waive.
23. Governing law
These Terms and disputes relating to them are governed by the laws of the State of New York, without regard to conflict-of-law rules, except where federal law or non-waivable law of another jurisdiction applies.
24. Severability and waiver
If a provision is held unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision once is not a waiver of the right to enforce it later.
25. Changes to these Terms
Luxury Next Season may update these Terms as the website, services or law change. The terms incorporated into a completed product transaction or accepted service engagement remain governed by the version or project terms applicable when that transaction or engagement was agreed, unless the parties lawfully agree otherwise.
26. Contact
